Tennessee drug-free workplace program
In Tennessee, a certified drug-free workplace program can lower your workers' compensation premium: 5%. Here's who certifies it and what it takes.
The program at a glance
- The discount: 5%.
- Who certifies it: Tennessee Dept. of Labor and Workforce Development (form DOL-DFWP-1 / LB-1111), renewed every year.
- What it requires: 60-day notice before it takes effect; five kinds of testing; random testing allowed, not required.
- Public contracts: T.C.A. 50-9-113: a drug-free workplace affidavit at bid time and a certificate of compliance from the Dept. of Labor and Workforce Development. Violators are barred from bidding until they comply. Applies to: Employers with 5 or more employees providing construction services to the state or a local government. Read the rule.
