Clearinghouse Requirements for Owner-Operators
If you drive a CDL truck under your own USDOT number, FMCSA treats you as both the employer and the driver. That means you have to meet the employer rules too. Here is what that looks like for the Drug and Alcohol Clearinghouse and random testing.

Are you an owner-operator under these rules?
FMCSA uses "owner-operator" here to mean an employer who employs himself or herself as a CDL driver, usually a one-driver operation. The Part 382 definition of employer includes a self-employed person.
If you run under another carrier's authority and USDOT number, you do not have to meet the employer rules. You register in the Clearinghouse as a driver only.

Step 1: Register as an employer (and a driver)
Register in the Clearinghouse as an employer and say yes when asked if you are an owner-operator. You need both the employer and driver roles. You can register both at once, or add the driver role after your company is set up.
FMCSA says every motor carrier should have an FMCSA Portal account. Logging in with it ties your Clearinghouse activity to your USDOT number. You will also need a Login.gov account.
Step 2: Designate a C/TPA
You must designate a C/TPA in the Clearinghouse. You cannot report your own violations. The C/TPA must do it.
Until you designate a C/TPA, the Clearinghouse will not let you take any action. Talk to the C/TPA first, and make sure it is already registered in the Clearinghouse.
Note: a consortium that only picks you for random tests is not automatically your designated C/TPA. You still have to designate one inside your Clearinghouse account.
Step 3: Buy a query plan and run your queries
As an employer, you must query the Clearinghouse on every CDL driver you employ, and that includes yourself. That means at least one query per year, plus a pre-employment query for any new driver you hire.
You must buy the query plan yourself. Queries are $1.25 each. Your C/TPA can run queries for you, but it cannot buy the plan.
Step 4: Join a random testing pool
A one-driver company cannot run a fair random program alone. The rule says an employer who employs only himself or herself must be in a random selection pool of two or more covered employees. In practice, that means joining a consortium's pool.
For 2026, the FMCSA minimum random rates are 50% for drugs and 10% for alcohol. The rates did not change from 2025. Each driver in the pool must have an equal chance of being picked each time selections are made.
You still carry the other testing rules, such as the pre-employment drug test before you first drive. Pact Compliance can serve as your designated C/TPA and include you in a random testing pool.

Common questions
Do owner-operators have to query themselves in the Clearinghouse?
Yes. FMCSA says anyone who employs a CDL holder must query the Clearinghouse, and that includes owner-operators who employ themselves.
Why do owner-operators need a C/TPA?
49 CFR 382.705(b)(6) says an employer who employs himself or herself as a driver must designate a C/TPA to report violations related to his or her own drug and alcohol use.
Can an owner-operator be in a random pool by themselves?
No. 49 CFR 382.103(b) requires a random pool of two or more covered employees, which is why most owner-operators join a consortium.
I'm leased on to a carrier. Do I need to register as an employer?
No. FMCSA says if you run under another motor carrier's USDOT number, you register as a driver. The carrier handles the employer duties.
Who buys the query plan for an owner-operator?
The owner-operator does. FMCSA says C/TPAs cannot buy query plans on behalf of employers.
What are the 2026 random testing rates for FMCSA?
50% for drugs and 10% for alcohol, based on the average number of driver positions. DOT's ODAPC says the rates did not change for 2026.
