ModivCare Driver Credentialing Requirements for NEMT Providers

Short answer: ModivCare's credentialing reminder for out-of-network transportation providers lists four records for every driver: a federal exclusion check at hire and every month, a copy of a valid driver's license, a yearly motor vehicle report, and proof the driver hasn't violated state drug laws, such as a yearly criminal background check. Keep the records 10 years and be ready to hand them over within 3 business days. ModivCare audits a sample of providers every quarter. This page lays out each item in plain terms, from ModivCare's own document.

The four records ModivCare lists for each driver

ModivCare's reminder says out-of-network transportation providers must collect, verify and keep driver credentialing records, at a minimum:

The exclusion check: OIG, SAM and your state

ModivCare explains that CMS requires NEMT providers to confirm each driver isn't excluded from federal health care programs. It asks providers to check each driver against three kinds of lists: the HHS Office of Inspector General list (exclusions.oig.hhs.gov), the federal System for Award Management (sam.gov/content/exclusions), and any state exclusion list that applies. It says the industry standard is to run these checks every month.

For each check, ModivCare asks you to save a PDF of the result showing the date of the check, the driver's full name, the name and web address of the list, the result, and the vendor that ran it, if any. If a possible match comes up on the OIG list, you verify it with the driver's Social Security number. A driver who matches either list can't take ModivCare trips.

How long to keep records, and audits

ModivCare says to keep these records for 10 years, per your agreement with ModivCare, and that you may be asked to produce them within 3 business days.

ModivCare audits a sample of out-of-network providers every quarter, and any company can be picked. Failing the audit means a corrective action plan, more education and a repeat audit the next quarter. Not meeting the requirements can mean fewer trips or the end of the contract.

How Pact helps (and what it doesn't do)

Pact's NEMT driver files keep each driver's license, driving record, background check, drug screen and training certificates in one place, with reminders before anything runs out, and check every driver against OIG's list and the state Medicaid exclusion lists that publish a file, every month, with a dated record of each check. You can download a driver's whole file at any time for an audit.

Pact's monthly check doesn't cover SAM.gov: run that one yourself at sam.gov/content/exclusions and upload the saved PDF to the driver's file. Pact doesn't run fingerprint or federal court checks, and the background check and driving record themselves come from a screening company. Your ModivCare contract is the final word on what your company needs.
