Oregon drug testing laws for employers
Oregon has no broad drug testing statute, but it has procedure rules that bind any employer that tests. On-site instant screens need a state permit, and a positive must be confirmed by a certified lab before it is used for a job decision. Breath alcohol tests are limited, and adult-use cannabis is legal with no employment protection in the cannabis law.
Have a whole roster to keep current every month? DOT fleets: Pact's monthly DOT program, $25 a driver a month ($99 minimum), or $19 a month for an owner-operator. Nursing homes, hospice and home care: staff credential tracking, $10 a staff member a month ($250 minimum). First month free.
The state law
- Anyone using on-site instant drug screens must file a permit application with the Oregon Health Authority, pay a yearly fee, and certify they follow the FDA package insert, chain of custody and manufacturer training (ORS 438.435(2)).
- A positive on-site screen must be confirmed by a state-certified clinical lab, or an equivalent out-of-state lab, before it is used to deny a job or benefit (ORS 438.435(2)(b)(E), (4)).
- If a test done outside Oregon is used to deny a job, you must be able to show it meets Oregon's testing standards (ORS 438.435(5)).
- You may not give an employee or applicant a breathalyzer test unless they consent or you have reasonable grounds to believe they are under the influence of alcohol (ORS 659A.300(1), (4)).
- With reasonable grounds, you may require a blood alcohol test by a third party or a breath test, and you may not make the employee pay for it (ORS 659A.300(4)).
Testing applicants
- We found no Oregon law that requires a job offer before an applicant drug test (no statute found).
- A breath alcohol test of an applicant needs the applicant's consent or reasonable grounds to believe they are under the influence (ORS 659A.300(1), (4)).
- A positive instant screen of an applicant must be lab-confirmed before you deny the job (ORS 438.435(4)).
Random testing
- We found no Oregon law that limits random drug testing by private employers (no statute found).
- A random breath alcohol test needs the person's consent or reasonable grounds to believe they are under the influence (ORS 659A.300(4)).
- Oregon's unemployment law recognizes reasonable written policies that include blanket, random, periodic and probable cause testing (ORS 657.176(8)(a)(A)).
Marijuana (recreational)
- Oregon's adult-use cannabis law does not change state or federal employment law (ORS 475C.013(1)).
- The medical cannabis law does not require employers to accommodate medical use in the workplace (ORS 475C.780(2)).
- Oregon's off-duty use protection names only lawful tobacco products (ORS 659A.315).
- We found no Oregon law that bars pre-employment marijuana testing or protects off-duty cannabis use (no statute found).
Also good to know
- For unemployment benefits, a worker who tests positive for alcohol, cannabis or an unlawful drug in connection with work, or who refuses a test under your reasonable written policy, has committed a disqualifying act (ORS 657.176(8)(a)(B), (F)).
- That disqualification does not apply if the worker is in a recognized rehab program on the separation date or within 10 days, unless they refused or broke a last chance agreement (ORS 657.176(8)(b)).
- A worker who quits to avoid a drug, cannabis or alcohol test under your reasonable written policy is also disqualified (ORS 657.176(9)(c)).
