Maryland drug testing laws for employers
Maryland has a testing law that binds every employer that tests for job reasons: you must use a state-permitted lab, instant tests are for applicants only, and people who test positive get written results and a retest right. Adult-use cannabis is legal, but we found no state law that protects private workers' off-duty use. Insurers may offer up to a 4% workers' comp discount for drug-free workplace programs.
Have a whole roster to keep current every month? DOT fleets: Pact's monthly DOT program, $25 a driver a month ($99 minimum), or $19 a month for an owner-operator. Nursing homes, hospice and home care: staff credential tracking, $10 a staff member a month ($250 minimum). First month free.
The state law
- Job-related drug and alcohol tests must go to a lab that holds a Maryland permit, or an out-of-state lab the state has approved (Md. Code, Health-Gen. 17-214(b)(1)(i)).
- If the person asks at the time of testing, you must tell them the name and address of the lab (Md. Code, Health-Gen. 17-214(b)(1)(ii)).
- After a confirmed positive, you must give the person a copy of the lab result, your written drug and alcohol policy, any notice of planned discipline, and a statement of their right to an independent retest (Md. Code, Health-Gen. 17-214(c)(1)).
- Those papers must be given in person or by certified mail within 30 days from the test date (Md. Code, Health-Gen. 17-214(c)(2)).
- The person may have the same sample retested by another permitted lab at their own cost (Md. Code, Health-Gen. 17-214(e)).
- The lab, doctor or anyone else may not tell you about the person's use of legal non-prescription drugs, or prescribed drugs they can show were prescribed (Md. Code, Health-Gen. 17-214(i)(1)).
- The rules apply to applicants, employees and contractors (Md. Code, Health-Gen. 17-214(h)).
- Workers' comp insurers may file a plan giving up to a 4% premium discount for an alcohol- and drug-free workplace policy, but they do not have to give it to employers already required by law to test (Md. Code, Ins. 11-329(f)(4)).
Testing applicants
- You may use an instant (single-use, on-site) test only on job applicants, unless a union contract bars it (Md. Code, Health-Gen. 17-214(b)(2)(i), (iv)).
- A positive instant test must be sent to a permitted lab for confirmation (Md. Code, Health-Gen. 17-214(b)(2)(ii)).
- A medical review officer must review an applicant's positive instant test after the lab confirms it (Md. Code, Health-Gen. 17-214(j)(1)).
- If you use instant tests, you must train the people who collect and read them and keep training and chain-of-custody records (Md. Code, Health-Gen. 17-214(d), (k)).
- Hair may be used only for pre-employment tests, and the sample may be no longer than 1.5 inches (Md. Code, Health-Gen. 17-214(b)(3)).
Random testing
- We found no state law that limits random testing by private employers, but every test must follow the lab and notice rules above (Md. Code, Health-Gen. 17-214).
- You may not use instant tests on current employees; their samples go straight to a permitted lab (Md. Code, Health-Gen. 17-214(b)(2)(iv)).
Marijuana (recreational)
- Adults 21 and older may legally have a personal use amount of cannabis (Md. Code, Crim. Law 5-601(a)(1)(ii)).
- We found no Maryland law that protects private employees' off-duty cannabis use or medical cannabis status, so you may keep a zero-tolerance policy (no statute found).
- From October 1, 2026, government employers may not act against firefighters, EMTs or paramedics only for holding a medical cannabis certification or testing positive with one; this does not cover private employers (Md. Code, State Gov't 20-606, 2026 Md. Laws ch. 183).
Also good to know
- Labs doing confirmation tests must be accredited in forensic drug analysis and follow federal or state cutoff levels (Md. Code, Health-Gen. 17-214(f)(2)).
