Oklahoma background check laws for employers
Oklahoma has no ban-the-box law for private employers. Its one extra screening rule is that the pre-check notice must include a box the applicant can check to get a free copy of the report. Employers may not require applicants to disclose sealed records, and applicants may answer as if sealed matters never happened.
Have a whole roster to keep current every month? DOT fleets: Pact's monthly DOT program, $25 a driver a month ($99 minimum), or $19 a month for an owner-operator. Nursing homes, hospice and home care: staff credential tracking, $10 a staff member a month ($250 minimum). First month free.
Fair-chance hiring (criminal history)
- No Oklahoma statute was found that limits when private employers may ask about or use criminal history.
State consumer report rules
- Before ordering a consumer report for employment, the employer must give the person written notice that a report will be used (24 O.S. § 148(A)).
- The notice must include a box the person can check to get a copy of the report (24 O.S. § 148(A)).
- If the box is checked, the employer must ask the CRA to send the person a copy when it orders its own copy, at no charge to the person (24 O.S. § 148(A)).
How far back a report can go
- No Oklahoma law sets a 7-year or other lookback limit on consumer reports beyond the federal FCRA.
- Employers may not require an applicant, in an application, an interview, or otherwise, to disclose information in sealed records (22 O.S. § 19(G)).
- An applicant may leave sealed records out of answers about arrests and convictions and may say no such action ever occurred, and may not be denied just for refusing to disclose them (22 O.S. § 19(G)).
